隱私權政策

1. 前言

1.1 歡迎來到 FULI,此平台由 GDT Group Company Limited 及其子公司與關聯公司(個別或合稱「FULI」、「我們」或「我們的」)營運。FULI 嚴肅看待其在適用之隱私權法律和規範(下稱「隱私權法」)下的責任,並致力於尊重所有 FULI 網站及行動應用程式(合稱「本平台」)使用者的隱私權利與考量。我們將本平台及我們提供的服務統稱為「本服務」。使用者係指註冊帳戶並使用本平台的人(個別或合稱「使用者」、「您」或「您的」)。我們認知您託付給我們的個人資料的重要性,並相信我們有責任妥善管理、保護和處理您的個人資料。本隱私權政策(下稱「本政策」)旨在協助您了解我們如何蒐集、使用、揭露及/或處理您現在或未來提供給我們及/或我們持有的您的個人資料,並在您提供任何個人資料前,協助您做出明智的決定。請詳細閱讀本政策。如果您對我們的隱私權實務有任何疑問,請參閱本政策末尾的「有任何問題、疑慮或投訴嗎?請與我們聯繫」一節。

1.4 本政策適用於我們就蒐集、使用、揭露及/或處理您的個人資料而發出的任何其他通知、合約條款及同意條款,除非我們另有明確規定,否則本政策不得凌駕於該等通知或條款之上。

1.5 本政策適用於我們服務的所有使用者,包括買家、賣家、合作駕駛及商家,除非另有明確說明。

2. 何時蒐集個人資料?

2.1 我們將會/可能會在以下情況蒐集您的個人資料:
(a) 當您存取及/或使用我們的服務或平台,或向我們註冊帳戶時;
(b) 當您提交任何表格,包括但不限於申請表或與我們產品和服務相關的其他表格,無論是線上或實體形式;
(c) 當您簽訂任何協議或提供與您和我們互動相關的其他文件或資訊,或當您使用我們的產品和服務時;
(d) 當您與我們互動時,例如透過電話(將會被錄音)、信件、傳真、面對面會議、社交媒體平台和電子郵件,包括當您與我們的客戶服務專員互動時;
(e) 當您使用我們的電子服務,或透過我們的平台或服務與我們互動時。這包括但不限於透過 Cookie,我們可能會在您使用或存取應用程式或網站時部署該技術;
(f) 當您透過您的裝置授權,向我們的應用程式或平台揭露任何資訊時;
(g) 當您將您的 FULI 帳戶與您的社交媒體帳戶或其他外部帳戶連結,或使用其他社交媒體功能時,根據該服務提供者的政策;
(h) 當您透過我們的服務進行交易時;
(i) 當您向我們提供意見反應或投訴時;
(j) 當您報名參加競賽活動時;
(k) 當您因任何理由向我們提交您的個人資料時。
以上清單並非詳盡無遺,僅列出我們蒐集您個人資料的一些常見情況。

3. 會蒐集哪些個人資料?

3.1 FULI 可能蒐集的個人資料包括但不限於:

  • 姓名
  • 電子郵件地址
  • 出生日期
  • 帳單及/或寄送地址
  • 銀行帳戶詳細資料和付款資訊
  • 聯絡電話
  • 性別
  • 身分證或護照號碼
  • 身分證或護照上的地址
  • 有關您的網路、或您與之互動的任何人或帳戶的資訊
  • 照片、錄音或錄影
  • 政府機關核發的身份證明文件或我們為進行盡職調查、客戶身份驗證 (KYC)、身份驗證或預防詐欺所需之其他資訊
  • 通訊和行銷偏好,例如您接收我們及第三方行銷資訊的偏好、您的通訊偏好,以及與我們、我們的服務提供者及其他第三方的通訊歷史記錄
  • 交易和使用資料,包括搜尋查詢、訂單、您在平台上互動的廣告和內容,以及其他與您相關的產品和服務的詳細資訊
  • 位置資料
  • 使用者註冊使用我們的服務或平台時的任何其他資訊,以及使用者使用服務或平台時的相關資訊,包括該使用者如何使用我們的服務或平台的資訊

3.2 您同意不向我們提交任何不準確或誤導性的資訊,並同意告知我們任何不準確之處或變更。我們保留全權酌情要求提供進一步文件以驗證您所提供資訊的權利。

3.3 如果您使用您的社交媒體帳戶(下稱「社交媒體帳戶」)註冊成為我們平台的使用者,或將您的 FULI 帳戶與您的社交媒體帳戶連結,或使用任何 FULI 的社交媒體功能,我們可能會存取您根據該社交媒體帳戶提供者的政策自願提供給該提供者的資訊,我們將始終根據本政策管理和使用您的個人資料。

4. 其他資料的蒐集

5. Cookie

(m) 允許進行稽核和調查,以驗證我們目標受眾的規模和組成,並了解他們使用 FULI 服務的體驗;

(v) 處理及/或促進商業資產交易或潛在的商業資產交易,其中該交易涉及 FULI 作為參與方,或僅涉及 FULI 的關聯公司或關係企業作為參與方,或涉及 FULI 及/或任何一個或多個 FULI 的關聯公司或關係企業作為參與方,且可能有其他第三方組織作為該交易的參與方。「商業資產交易」指任何組織或其一部分,或任何業務或資產的購買、出售、租賃、合併、聯合或其他收購、處置或融資;及/或
(w) 我們在徵求您同意時通知您的任何其他目的。(合稱「目的」)

6.2 您知悉、同意並接受,如果法律、法院命令或任何對 FULI 有管轄權的政府機關要求,FULI 可以存取、保存和揭露您的帳戶資訊和「內容」,或基於善意相信此類存取、保存或揭露是合理必要的,以:(a) 遵守任何法律程序;(b) 遵守任何對 FULI 有管轄權的政府機關的命令;(c) 執行本服務條款和本隱私權政策;(d) 回應任何針對 FULI 的威脅或實際索賠,或任何「內容」侵犯第三方權利的索賠;(e) 回應您的客戶服務請求;或 (f) 保護 FULI、其使用者及/或公眾的權利、財產或人身安全。

6.3 由於我們蒐集、使用、揭露及/或處理您個人資料的目的取決於當時的情況,該目的可能未在上述列出。然而,除非適用隱私權法允許我們在未經您同意的情況下處理您的資料,否則我們將在徵求您同意時通知您此類其他目的。

7. 如何保護和保存客戶資訊?

7.1 我們實施各種安全措施,並盡力確保您在我們系統中的個人資料安全。使用者個人資料儲存在安全的網路之後,只有少數具備此類系統特殊存取權限的員工可以存取。然而,我們無法保證您個人資料的絕對安全。

7.2 我們將根據隱私權法及/或其他適用法律保存您的個人資料。當我們有合理理由認為 (i) 蒐集個人資料的目的已不再因保存該個人資料而達成,且 (ii) 為任何法律或商業目的不再需要保存該個人資料,且 (iii) 沒有其他合法利益需要進一步保存該個人資料時,我們將立即銷毀或匿名化您的個人資料。如果您停止使用本平台,或您使用本平台及/或服務的權限被終止或撤銷,我們可能會根據隱私權法和我們在此法律下的義務,繼續儲存、使用及/或揭露您的個人資料。根據適用法律,我們可能會在不另行通知您的情況下,安全地銷毀您的個人資料。

8. 是否會向第三方揭露從訪客蒐集到的資訊?

8.1 在我們的業務營運中,我們可能需要為上述第 6.1 節所述的一個或多個目的,將您的個人資料使用、處理、揭露及/或轉移給我們的第三方服務提供者、代理商及/或我們的關聯公司或關係企業,及/或其他可能位於泰國境內或境外的第三方。此類第三方服務提供者、代理商及/或關聯公司或關係企業及/或其他第三方將代表我們或以其他方式,為上述第 6.1 節所述的一個或多個目的處理您的個人資料。我們努力確保第三方和我們的關聯公司保護您的個人資料,避免未經授權的存取、蒐集、使用、揭露、處理或類似風險,並且僅在您的個人資料為上述第 6.1 節所述目的所需期間內保存您的個人資料。此類第三方包括但不限於:
(a) 我們的子公司、關係企業和關聯公司;在此情況下,該子公司、關係企業或關聯公司可能會為了與其服務營運相關的目的,根據適用的隱私權法及該公司自身的隱私權政策,蒐集、使用或處理收到的個人資料;
(b) 您透過本平台進行交易或互動的買家、賣家、合作駕駛或商家,或與您為上述目的使用我們的服務相關者;
(c) 為上述第 6.1 節所述的一個或多個目的而使用本平台的其他使用者;
(d) 我們用於支援我們業務的承包商、代理商、服務提供者和其他第三方。這些包括但不限於向我們提供行政或其他服務的單位,例如郵寄公司、物流服務公司、金融服務公司、廣告和行銷合作夥伴、電信公司、資訊科技公司和資料中心;
(e) 對 FULI 具有管轄權的政府或監管機關,或如第 6.2 節所允許者;
(f) 在合併、撤資、重組、改組、解散或出售或轉移 FULI 部分或全部資產(無論是作為持續經營或是破產、清算或類似程序的一部分)時的買方、繼承人或受讓人,其中 FULI 持有的關於我們服務使用者的個人資料屬於轉移的資產之一;
(g) 我們為上述第 6.1 節所述的一個或多個目的而向其揭露資訊的第三方,而該等第三方亦會為上述第 6.1 節所述的一個或多個目的蒐集和處理您的個人資料。

8.2 我們可能會與廣告合作夥伴及其他提供廣告、再行銷及/或程式化服務的第三方分享有關我們使用者及其服務使用情況的資訊,包括統計和人口統計資訊。

8.3 為免疑義,在隱私權法或其他適用法律允許組織(例如我們)在未經您同意的情況下蒐集、使用或揭露您的個人資料的情況下,該等法律賦予的許可應繼續適用。根據適用法律,我們可能會根據相關的法律處理基礎使用您的個人資料,可能會為相關目的引用一個或多個基礎,如第 6.1 節所述。這包括:為履行法律義務的法律基礎、為履行與您的合約的合約基礎、為我們的合法利益和使用您資料的理由(我們將考量這對您資料保護權利的影響)、為您已同意的其他利益(必要時我們會不時向您徵求),或在與任何法律索賠相關時的必要情況。

8.5 如 FULI 服務條款中所述,任何透過使用我們的服務而持有其他「使用者」個人資料的「使用者」(包括其任何員工、代理人、代表或任何為該使用者或代表該使用者行事的人)(下稱「接收方」)在此同意 (i) 將遵守所有與此類資料相關的適用隱私權法,包括任何對該資料的蒐集、處理、儲存或轉移;(ii) 允許 FULI 或其個人資料被接收方蒐集的其他「使用者」(下稱「揭露方」)從接收方的資料庫中刪除其被蒐集的個人資料;以及 (iii) 允許 FULI 或揭露方審查接收方蒐集了哪些關於他們的資訊,在上述 (ii) 和 (iii) 的每種情況下,均須遵守並在適用法律要求時遵守。

8.6 儘管本政策中有任何規定,賣家或商家(包括其任何員工、代理人、代表或任何為該使用者或代表該使用者行事的人)和合作駕駛必須遵守所有適用的隱私權法,並且對於從 FULI 收到的任何買家個人資料,(i) 不得使用此類買家個人資料,除非有合理必要回應買家的查詢並執行、處理、管理或完成交易,而未經買家和 FULI 的事先書面同意;(ii) 不得使用此類資訊在 FULI 平台之外與買家聯繫;(iii) 不得在未經買家和 FULI 的事先書面同意下向任何第三方揭露此類買家的個人資料;(iv) 應採取足夠的安全措施保護其持有的每個 FULI 使用者的個人資料,並且僅在為本節所述目的及適用隱私權法所要求之期間內保存此類資料,並應在 FULI 提出要求或交易完成後盡快刪除或返還此類資料給 FULI;以及 (v) 如果懷疑任何此類使用者資料發生個人資料外洩或遺失,必須通知 FULI 的個人資料保護長,電子郵件為 tw.support@gdt.asia。

9. 兒童資訊

本服務不適用於 13 歲以下的兒童。我們不會故意蒐集或保存任何 13 歲以下人士的個人資料或非個人可識別資訊,也不會將我們平台或服務的任何部分導向 13 歲以下的兒童。請父母或法定監護人確保您所監護的兒童不會向 FULI 提交個人資料。如果 FULI 收到您所監護的 13 歲以下兒童的個人資料,即表示您同意我們持有該個人資料,並代表該兒童接受並同意受本隱私權政策條款的約束。然而,我們將關閉任何由兒童使用的帳戶,並將刪除及/或銷毀我們認為在未經父母或法定監護人同意下由 13 歲以下兒童提交的任何個人資料。

10. 由第三方蒐集的資訊

10.1 我們的平台使用 Google Analytics,這是一項由 Google, Inc.(下稱「Google」)提供的網站分析服務。Google Analytics 使用 Cookie(儲存在您電腦上的文字檔案)來幫助平台分析使用者如何使用網站。由 Cookie 產生的關於您使用平台(包括您的 IP 位址)的資訊將由 Google 傳送並儲存在美國的伺服器上。Google 將使用此資訊評估您對平台的使用情況,為平台營運商編制網站活動報告,並提供與網站活動和網際網路使用相關的其他服務。在法律要求或此類第三方代表 Google 處理資訊的情況下,Google 也可能將此資訊轉移給第三方。Google 不會將您的 IP 位址與 Google 持有的任何其他資料關聯。

11. 關於安全和第三方網站的免責聲明

11.1 我們不保證您在第三方網站上提供的個人資料及/或其他資訊的安全性。我們實施各種安全措施以維護我們持有或控制的您的個人資料的安全性。使用者個人資料儲存在安全的網路之後,只有少數具備此類系統特殊存取權限並被要求對個人資料保密的人員可以存取。當您下訂單或存取您的個人資料時,我們建議使用安全的伺服器。您提供的所有個人資料或敏感資訊都會被加密到我們的資料庫中,只有如上所述的人員才能存取。

11.2 為了給您帶來更多價值,我們可能會選擇各種第三方網站連結到本平台或在本平台內安裝。我們也可能參與聯合品牌或其他關係,以便向訪客提供電子商務及/或其他服務和功能。這些連結的網站有其各自獨立的隱私權和安全政策。即使第三方與我們有關聯,我們也無法控制這些連結的網站,因為每個網站都有獨立於我們的隱私權和資料蒐集作法。我們聯合品牌合作夥伴或第三方網站(即使是在我們的平台上或透過我們的平台提供)蒐集的資料可能不會由我們接收。

1.1 Welcome to FULI, a platform operated by GDT Group Company Limited and its subsidiaries and affiliates (individually and collectively, "FULI", "we", "us" or "our"). FULI takes its responsibilities under applicable privacy laws and regulations ("Privacy Laws") seriously and is committed to respecting the privacy rights and concerns of all users of our FULI website and mobile application (collectively, the "Platform"). We refer to the Platform and the services we provide as described on our Platform collectively as the "Services". "Users" refers to a user who has registered for an account with us and uses the Platform (individually and collectively, “Users”, "you" or "your"). We recognize the importance of the personal data you have entrusted to us and believe that it is our responsibility to properly manage, protect and process your personal data. This Privacy Policy ("Policy") is designed to assist you in understanding how we collect, use, disclose and/or process the personal data you have provided to us and/or we possess about you, whether now or in the future, as well as to assist you in making an informed decision before providing us with any of your personal data. 1.2 "Personal Data" means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organization has or is likely to have access. 1.3 By using the Services, registering for an account with us, visiting our Platform, and/or accessing the Services, you acknowledge and agree that you accept the practices, requirements, and/or policies outlined in this Privacy Policy, and you hereby consent to us collecting, using, disclosing and/or processing your personal data as described herein. IF YOU DO NOT CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA AS DESCRIBED IN THIS PRIVACY POLICY, PLEASE DO NOT USE OUR SERVICES OR ACCESS OUR PLATFORM. If we change our Privacy Policy, we will notify you including by posting those changes or the amended Privacy Policy on our Platform. To the fullest extent permitted under applicable law, your continued use of the Services or Platform, including placing any orders, following the modifications, constitutes your acknowledgement and acceptance of the changes to this Privacy Policy.

1.4 This Policy applies in conjunction with any other notices, contractual clauses, and consent clauses that apply in relation to the collection, use, disclosure and/or processing of your personal data by us, and is not intended to override them unless we state explicitly otherwise.

1.5 This Policy applies to all users of our Services, including buyers, sellers, driver partners, and merchants, unless stated otherwise.

2. When Will FULI Collect Personal Data?

2.1 We will/may collect your personal data when:
(a) you access and/or use our Services or Platform, or register for an account with us;
(b) you submit any form, including, but not limited to, application forms or other forms relating to any of our products and services, whether online or by way of a physical form;
(c) you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our products and services;
(d) you interact with us, such as via telephone calls (which will be recorded), letters, faxes, face-to-face meetings, social media platforms and emails, including when you interact with our customer service agents;
(e) you use our electronic services, or interact with us through our Platform or use our Services. This includes, without limitation, through cookies which we may deploy when you use or access the application or website;
(f) you grant permissions on your device to share information with our application or Platform;
(g) you link your FULI account with your social media account or other external account or use other social media features, in accordance with the provider’s policies;
(h) you carry out transactions through our Services;
(i) you provide us with feedback or complaints;
(j) you register for a contest;
(k) you submit your personal data to us for any reason.
The above does not purport to be exhaustive and sets out some common instances of when personal data about you may be collected.

3. What Personal Data Will FULI Collect?

3.1 The personal data that FULI may collect includes but is not limited to:

  • Name
  • Email address
  • Date of birth
  • Billing and/or delivery address
  • Bank account details and payment information
  • Contact number
  • Gender
  • ID or passport number
  • Address on ID or passport
  • Information about your network or any person or account you interact with
  • Photographs, audio or video recordings
  • Government-issued identification or other information required for our due diligence, know-your-customer (KYC), identity verification, or fraud prevention purposes
  • Marketing and communications preferences, such as your preferences in receiving marketing information from us and third parties, your communication preferences, and communication history with us, our service providers, and other third parties
  • Transaction and usage data, including details about your search queries, orders, the advertisements and content you interact with on the Platform, and other products and services related to you
  • Location data
  • Any other information about the user when the user signs up to use our Services or Platform, and when the user uses the Services or Platform, as well as information related to how the user uses our Services or Platform
  • Personal data you may provide to us through the Platform

3.2 You agree not to submit any information to us which is inaccurate or misleading, and you agree to inform us of any inaccuracies or changes to such information. We reserve the right at our sole discretion to require further documentation to verify the information provided by you.

3.3 If you sign up to be a user of our Platform using your social media account (“Social Media Account”), link your FULI account to your Social Media Account or use any FULI social media features, we may access information about you which you have voluntarily provided to your Social Media Account provider in accordance with such provider's policies, and we will manage and use your personal data in accordance with this Policy at all times.

3.4 If you do not want us to collect the foregoing information/personal data, you may opt out at any time via the Platform or by notifying our Data Protection Officer in writing. Further information on opting out can be found in the section below entitled "How can you withdraw consent, remove, request access to or modify information you have provided to us?". Note, however, that opting out of or withdrawing your consent for us to collect, use or process your personal data may affect your use of the Services. For example, opting out of the collection of location information will cause its location-based features to be disabled.

4. Collection of Other Data

4.1 As with most websites and mobile applications, your device sends information which may include data about you that gets logged by a web server when you browse our Platform. This typically includes, without limitation, your device’s Internet Protocol (IP) address, computer/mobile device operating system, browser version, type of mobile device, characteristics of the mobile device, the unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device, the address of a referring web site (if any), the pages you visit on our website and mobile applications and the times of visit, and sometimes a "cookie" (which can be disabled using your device preferences) to help the site remember your last visit. If you are logged in, this information is associated with your user account. The information is also included in anonymous statistics to allow us to understand how visitors use our Platform.

4.2 Our mobile applications may collect precise information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc. We collect, use, disclose and/or process this information for one or more Purposes (see Section 6.1), including, without limitation, location-based services that you request or to deliver relevant content to you based on your location or to allow you to share your location with other Users as part of the services under our mobile applications. For most mobile devices, you are able to withdraw your permission for us to acquire this information on your location through your device settings. If you have questions about how to disable your mobile device's location services, please contact your mobile device service provider or the device manufacturer.

4.3 As when you view pages on our website or mobile application, when you watch content and advertising and access other software on our Platform or through our Services, most of the same information is sent to us (including, without limitation, IP Address, operating system, etc.); but, instead of page views, your device sends us information on the content, advertisement viewed and/or software installed by the Services and the Platform and the time.

5. Cookie

5.1 We or our authorized service providers and advertising partners may from time to time use "cookies" or other features to allow us or third parties to collect or share information in connection with your use of our Service or Platform. These features help us improve our Platform and the Services we offer, or help us offer new services and features, and/or enable us and our advertising partners to serve more relevant content to you, including through remarketing. “Cookies” are identifiers that are stored on your computer or mobile device that record data about your computer or device, how and when the Services or Platform are used or visited, by how many people, and other activity within our Platform. We may link cookie information to your personal data. Cookies also link to information regarding what items you have selected for purchase and the web pages you have viewed. This information is used to keep track of your shopping cart, to deliver content specific to your interests, to enable our third-party advertising partners to serve advertisements on sites across the Internet, and to conduct data analysis and to monitor usage of the Services.

5.2 We use the following types of cookies:
(a) Strictly necessary cookies: These are cookies that are required for the operation of the website. They include, for example, cookies that enable you to log into secure areas of the website, use a shopping cart, or make use of e-billing services.
(b) Analytical/performance cookies: These allow us to recognize and count the number of visitors and to see how visitors move around the website when they are using it. This helps us to improve the way the website works, for example, by ensuring that users are finding what they are looking for easily.

5.5 Except for strictly necessary cookies, all cookies will expire within 2 years.

6. How Do We Use the Information You Provide Us?

6.1 We may collect, use, disclose and/or process your personal data for one or more of the following purposes:
(a) to consider and/or process your application/transaction with us or your transactions or communications with third parties via the Services;
(b) to manage, operate, provide and/or administer your use of and/or access to our Services and our Platform, as well as your relationship and user account with us;
(c) to respond to, process, deal with or complete a transaction and/or to fulfill your requests for certain products and services and notify you of service issues and unusual account actions;
(d) to enforce our Terms of Service or any applicable end user license agreements;
(e) to protect personal safety and the rights, property or safety of others;
(f) for identification, verification, due diligence, or know-your-customer (KYC) purposes;
(g) to evaluate and make decisions regarding your credit and risk profile for any credit products;
(h) to maintain and administer any software updates and/or other updates and support that may be required from time to time to ensure the smooth running of our Services;
(i) to deal with or facilitate customer service, carry out your instructions, deal with or respond to any enquiries given by (or purported to be given by) you or on your behalf;
(j) to contact you or communicate with you via voice call, text message and/or fax message, email and/or postal mail or otherwise for the purposes of administering and/or managing your relationship with us or your use of our Services, such as but not limited to communicating administrative information to you relating to our Services. You acknowledge and agree that such communication by us could be by way of the mailing of correspondence, documents or notices to you, which may involve disclosure of certain of your personal data on the external cover of envelopes/mail packages for delivery;
(k) to allow other users to interact, connect with you or see some of your activities on the Platform, including to inform you when another user has sent you a private message, posted a comment for you on the Platform or connected with you using social media features on the Platform;
(l) to conduct research, analysis and development activities (including, but not limited to, data analytics, surveys, product and service development and/or profiling), to analyze how you use our Services, to recommend products and/or services relevant to your interests, to improve our Services or products and/or to enhance your customer experience;
(m) to allow for audits and surveys to, among other things, validate the size and composition of our target audience, and understand their experience with FULI’s Services;
(n) for marketing and advertising, and in this regard, to send you by various modes of communication, marketing and promotional information and materials relating to products and/or services (including, without limitation, products and/or services of third parties whom FULI may collaborate or tie up with) that FULI (and/or its affiliates or related corporations) may be selling, marketing or promoting, whether such products or services exist now or are created in the future. You can unsubscribe from receiving marketing information at any time by using the unsubscribe function within the electronic marketing material. We may use your contact information to send newsletters or marketing materials from us or our related companies;
(o) to respond to legal processes or to comply with or as required by any applicable law, governmental or regulatory requirements of any relevant jurisdiction, or where we have a good faith belief that such disclosure is necessary, including, without limitation, meeting the requirements to make disclosure under the requirements of any law binding on FULI or its related corporations or affiliates (including, where applicable, the display of your name, contact details and company name);
(p) to produce statistics and research for internal and statutory reporting and/or record-keeping requirements;
(q) to carry out due diligence or other screening activities (including, without limitation, background checks) in accordance with legal or regulatory obligations or our risk management procedures that may be required by law or that may have been put in place by us;
(r) to audit our Services or FULI's business;
(s) to prevent or investigate any actual or suspected violation of our Terms of Service, fraud, unlawful activity, omission or misconduct, whether relating to your use of our Services or any other matter arising from your relationship with us;
(t) to respond to any threatened or actual claims asserted against FULI or other claim that "Content" violates the rights of third parties;
(u) to store, host, back up (whether for disaster recovery or otherwise) of your personal data, whether within or outside of your jurisdiction;
(v) to deal with and/or facilitate a business asset transaction or a potential business asset transaction, where such transaction involves FULI as a participant or involves only a related corporation or affiliate of FULI as a participant or involves FULI and/or any one or more of FULI's related corporations or affiliates as participant(s), and there may be other third-party organizations who are participants in such transaction. A “business asset transaction” refers to the purchase, sale, lease, merger, amalgamation or any other acquisition, disposal or financing of an organization or a portion of an organization or of any of the business or assets of an organization; and/or
(w) any other purposes which we notify you of at the time of obtaining your consent. (collectively, the “Purposes”).

6.2 You acknowledge, consent and agree that FULI may access, preserve and disclose your account information and "Content" if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over FULI or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with any legal process; (b) comply with any order from any governmental or regulatory authority having jurisdiction over FULI; (c) enforce the Terms of Service and this Privacy Policy; (d) respond to any threatened or actual claims asserted against FULI or other claim that any "Content" violates the rights of third parties; (e) respond to your requests for customer service; or (f) protect the rights, property or personal safety of FULI, its users and/or the public.

6.3 As the purposes for which we will/may collect, use, disclose and/or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of the applicable data without your consent is permitted by the Privacy Laws.

7. How Does FULI Protect and Retain Customer Information?

7.1 We implement a variety of security measures and strive to ensure the security of your personal data on our systems. User personal data is contained behind secured networks and is only accessible by a limited number of employees who have special access rights to such systems. However, we cannot guarantee the complete security of your personal data.

7.2 We will retain your personal data in accordance with the Privacy Laws and/or other applicable laws. That is, we will destroy or anonymize your personal data as soon as it is reasonable to assume that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any legal or business purposes; and (iii) there are no other legitimate interests to warrant further retention of such personal data. If you cease using the Platform, or your permission to use the Platform and/or the Services is terminated or withdrawn, we may continue storing, using and/or disclosing your personal data in accordance with the Privacy Laws and our obligations thereunder. Subject to applicable law, we may securely dispose of your personal data without prior notice to you.

8. Does FULI Disclose the Information It Collects from Its Visitors to Outside Parties?

8.1 In conducting our business, we will/may need to use, process, disclose and/or transfer your personal data to our third-party service providers, agents and/or our affiliates or related corporations, and/or other third parties, who may be located in or outside of Thailand, for one or more of the above-stated Purposes in Section 6.1. Such third-party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated Purposes in Section 6.1. We strive to ensure that the third parties and our affiliates keep your personal data secure from unauthorized access, collection, use, disclosure, processing or similar risks and retain your personal data only for as long as your personal data is needed to achieve the above-mentioned Purposes. Such third parties include, without limitation:
(a) our subsidiaries, affiliates and related corporations; in which case the subsidiary, affiliate, or related corporation may collect, use, or process the personal data received for purposes related to the operation of its services, subject to applicable Privacy Laws and the company's own privacy policy;
(b) buyers, sellers, driver partners or merchants you have transacted or interacted with on the Platform or in connection with your use of our Services for the above-stated Purposes;
(c) other users of our Platform for one or more of the above-stated Purposes in Section 6.1;
(d) contractors, agents, service providers and other third parties we use to support our business. These include but are not limited to those who provide administrative or other services to us such as mailing houses, logistics service companies, financial services companies, advertising and marketing partners, telecommunication companies, information technology companies and data centers;
(e) governmental or regulatory authorities having jurisdiction over FULI or as permitted under Section 6.2;
(f) a buyer, successor or assignee in the case of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of FULI’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal data held by FULI about our Service users is among the assets transferred;
(g) third parties to whom disclosure by us is for one or more of the Purposes in Section 6.1 and such third parties would in turn be collecting and processing your personal data for one or more of the Purposes in Section 6.1.

8.2 We may share information, including statistical and demographic information, about our users and their use of the Services with advertising partners and other third parties who provide advertising, remarketing, and/or programming.

8.3 For the avoidance of doubt, in the event that Privacy Laws or other applicable laws permit an organization such as us to collect, use or disclose your personal data without your consent, such permission granted by the laws shall continue to apply. Subject to applicable law, we may use your personal data under the relevant legal processing bases, potentially referencing one or more bases for the relevant purposes as stated in Section 6.1. This includes: a legal basis for fulfilling legal obligations, a contractual basis for fulfilling a contract with you, for our legitimate interests and reasons for using your data (we will consider the impact on your data protection rights), for other interests for which you have given consent (which we will ask for from time to time as necessary), or when necessary in connection with any legal claims.

8.4 Third parties may unlawfully intercept or access personal data transmitted to or contained on the Platform, technologies may malfunction or not work as anticipated, or someone may access, abuse or misuse information through no fault of ours. We will, nevertheless, deploy reasonable security arrangements to protect your personal data as required by the Privacy Laws; however, there cannot be a guarantee of absolute security such as but not limited to when unauthorized disclosure arises from malicious and sophisticated hacking by malcontents through no fault of ours.

8.5 As set forth in the FULI Terms of Service, any User (including any employee, agent, representative, or any other person acting for such User or on such User's behalf) in possession of another User’s personal data through the use of our Services (the “Receiving Party”) hereby agrees that they will (i) comply with all applicable Privacy Laws with respect to any such data, including any collection, processing, storage, or transfer of such data; (ii) permit FULI or the other User whose personal data the Receiving Party has collected (the “Disclosing Party”) to remove his or her data so collected from the Receiving Party’s database; and (iii) permit FULI or the Disclosing Party to review what information has been collected about them by the Receiving Party, in each case of (ii) and (iii) above, in compliance with and where required by applicable laws.

8.6 Notwithstanding anything set forth herein, Sellers or Merchants (including any employee, agent, representative, or any other person acting for such User or on such User's behalf) and driver partners must comply with all applicable Privacy Laws and, in respect of any buyer’s personal data received from FULI, (i) are not permitted to use such buyer’s personal data except as reasonably necessary to respond to buyers’ enquiries and to carry out, process, manage or complete a transaction without the prior written consent of the buyer and FULI; (ii) must not contact buyers using such information outside of the FULI platform; (iii) are not permitted to disclose such buyer’s personal data to any unauthorized third parties without the prior written consent of the buyer and FULI; (iv) shall employ sufficient security measures to protect each FULI user’s personal data in their possession and to retain such data only for as long as necessary for the purposes specified herein and as required by the applicable Privacy Laws, and shall delete or return such data to FULI upon request from FULI or as soon as reasonably possible upon completion of the transaction; and (v) must notify FULI’s Personal Data Protection Officer at tw.support@gdt.asia in the event of any suspected personal data breach or loss of such user data.

9. Information on Children

The Services are not intended for children under the age of 13. We do not knowingly collect or maintain any personal data or non-personally-identifiable information from anyone under the age of 13 nor is any part of our Platform or other Services directed to children under the age of 13. We ask parents or legal guardians to please supervise and ensure that children under their care do not submit personal data to FULI. In the event that personal data of a child under the age of 13 in your care is disclosed to FULI, you hereby consent to the possession of that personal data and accept and agree to be bound by the terms in this Privacy Policy on behalf of such child. We will, however, close any accounts used exclusively by such children and will remove and/or delete any personal data which we believe was submitted without parental or legal guardian consent by a child under the age of 13.

10. Information Collected by Third Parties

10.1 Our Platform uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, which are text files placed on your computer, to help the Platform analyze how users use the site. The information generated by the cookie about your use of the Platform (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Platform, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage. Google will not associate your IP address with any other data held by Google.

10.2 We, and third parties, may from time to time make available software applications for your use on or through the Services. These applications may separately access, and allow a third party to view, your identifiable information, such as your name, your user ID, and your computer’s IP Address, or other information such as any cookies you may have previously installed or that were installed for you by a third-party software application or website. Additionally, these applications may ask you to provide additional information directly to third parties. Third-party products or services provided through these applications are not owned or controlled by FULI. You are encouraged to read the terms and other policies published by such third parties on their websites or otherwise.

11. Disclaimer Regarding Security and Third-Party Sites

11.1 WE DO NOT GUARANTEE THE SECURITY OF PERSONAL DATA AND/OR OTHER INFORMATION THAT YOU PROVIDE ON THIRD-PARTY SITES. We do implement a variety of security measures to maintain the safety of your personal data that is in our possession or under our control. User personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the personal data confidential. When you place orders or access your personal data, we offer the use of a secure server. All personal data or sensitive information you supply is encrypted into our databases to be only accessed as stated above.

11.2 In an attempt to provide you with increased value, we may choose various third-party websites to link to, and frame within, the Platform. We may also participate in co-branding and other relationships to offer e-commerce and other services and features to our visitors. These linked sites have separate and independent privacy and security policies. Even if the third party is affiliated with us, we have no control over these linked sites, each of which has separate privacy and data collection practices independent of us. Data collected by our co-brand partners or third-party websites (even if offered on or through our Platform) may not be received by us.

11.3 We therefore have no responsibility or liability for the content, security arrangements (or lack thereof) and activities of these linked sites. These linked sites are only for your convenience and you therefore access them at your own risk. Nonetheless, we seek to protect the integrity of our Platform and the links placed upon each of them and therefore welcome any feedback about these linked sites (including, without limitation, if a specific link does not work).

12. Will FULI Transfer Your Information Overseas?


Your personal data and/or information may be transferred to, stored or processed outside of your country of residence for one or more of the Purposes as set out in Section 6.1 above. In most cases, your personal data will be processed in Singapore, where our servers are located. You acknowledge and agree that the privacy and other laws of countries to which your information may be transferred, stored, or processed might not have standards of protection equivalent to the laws of your jurisdiction. However, we will provide appropriate safeguards to ensure that the rights of data subjects are enforceable, in accordance with the Privacy Laws.

13. How Can You Opt-Out, Withdraw Consent, Request Access to or Correct Information You Have Provided to Us?

13.1 Withdrawing Consent
13.1.1 You may withdraw your consent for the collection, use and/or disclosure of your personal data in our possession or under our control and/or request the deletion of your personal data by sending an email to our Personal Data Protection Officer at tw.support@gdt.asia, and we will process your request for withdrawal in accordance with this Privacy Policy, the Privacy Laws, and other applicable laws. However, your withdrawal of consent may mean that we will not be able to continue providing the Services to you, and we may need to terminate your existing relationship and/or the contract you have with us.
13.1.2 Where you have shared YouTube Content, in addition to withdrawing your consent by email as set out in Clause 13.1.1, you may revoke FULI’s access to your personal data via the Google security settings page at https://security.google.com/settings/security/permissions.

13.2 Requesting Access to or Correction of Personal Data
13.2.1 If you have an account with us, you may personally access and/or correct your personal data currently in our possession or control through the Account Settings page on the Platform. If you do not have an account with us, you may request to access and/or correct your personal data currently in our possession or control by submitting a written request to us. We will need enough information from you in order to ascertain your identity as well as the nature of your request so as to be able to deal with your request. Hence, please submit your written request by emailing our Personal Data Protection Officer at tw.support@gdt.asia.
13.2.2 For a request to access personal data, once we have sufficient information from you to deal with the request, we will seek to provide you with the relevant personal data within 30 days. Where we are unable to respond to your request within the said 30 days, we will inform you of the soonest possible time within which we can provide you with the information requested. Note that Privacy Laws may exempt certain types of personal data from your access request.
13.2.3 For a request to correct personal data, once we have sufficient information from you to deal with the request, we will:
(a) correct your personal data within 30 days. Where we are unable to do so within the said period, we will notify you of the soonest practicable time within which we can make the correction. Note that Privacy Laws may exempt certain types of personal data from a correction request as well as prescribe circumstances when correction need not be made by us despite your request; and
(b) we will send the corrected personal data to every other organization to which the personal data was disclosed by us within a year before the date the correction was made, unless that other organization does not need the corrected personal data for any legal or business purpose.
13.2.4 Notwithstanding sub-paragraph (b) above, we may, if you so request, send the corrected personal data only to specific organizations to which the personal data was disclosed by us within a year before the date the correction was made.
13.2.5 We may, to the extent permitted by law, charge a reasonable fee for the processing and handling of your requests to access your personal data. If we so choose to charge, we will provide you with a written estimate of the fee we will be charging. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee.
13.2.6 We reserve the right to refuse to correct your personal data in accordance with the provisions as set out in Privacy Laws, where they require and/or entitle an organization to refuse to correct personal data in stated circumstances.
